forecast a little later. >> okay spencer thank you. >> major break in bizarre case in san francisco visitation valley. man and woman were found bound and gagged in the middle of the street on sunday night. today police arrested 5 people in hercules connected they say to the crime. vick lee with the very latest on the investigation. >>reporter: police said 5 arrested for the attack on a man and woman found bound and gagged ncaa and dumped on the san francisco street range in age from 19 to 34. one from san francisco. 2 from oakland. and the other 2 have hercules addresses. police made the arrest day after a passing driver found the couple in the middle of russell street in the ingleside district. male victim 26-year-old steven reid died later at san francisco general hospital. police source tells us the suspects are brought in for questioning to the hall of justice yesterday after investigators received ladies from the public. they were later arrested at a house in hercules today in l early morning hours. police spokesman officer says everyone involved knew each other. >> t

in the upcoming term. california's proposition 8 is not on that list. ktvu's brian flores is in san francisco to tell us what that means for same-sex marriage here in california. >> reporter: hi, dave, good morning. it appears for now that opponents of proposition 8 will have to wait until the end of the week for any decision on this from the u.s. supreme court. we were waiting to hear some decision. but it appears the supreme court will at least delay it until about friday, though. the key was whether the prop was gonna be on their cases. now, if that happens, that means the decision won't come until june. this postpones any decision until later this week. come friday morning, we'll be at this to see if the supreme court agrees with the lower court on whether gay marriage is unconstitutional or if they will keep prop 8 as voted on back in 2008. a lot of reac-- a lot of reaction from the castro district. we'll stay on this. back to you. >> thank you. now, our washington, d.c. newsroom is also following this. coming up at 7:15, we'll have more analysis of what this morning's developments could

. we had some minor flooding on the embacadaro in san francisco, lake valley, around lake merr t merritt. basically it was a great opportunity to do tide pooling as well because the high is higher than normal, but the low is much lower than normal. so the people who got out and went to places like fitzgerald marine reserve on the san mateo coast, you could walk much, much further out at low tide. hundreds of yards further than you otherwise would have been able to. it was a great opportunity to teach your kids about, you know, star fish and all the other critters out there. >> will the severity of the king tides be exacerbated by global warming, any time? >> you know, it's interesting, because i think hurricane sandy really woke a lot of people up about the risk of rising sea level in the future for coastal communities. 75% of california residents live within an hour of the coast. and, you know, basically the ocean has already risen eight inches in the last 100 years. we can measure that by the tidal gauge at ft. point in san francisco which has sat there more than 100 years. the

interest rate they like. the san francisco city attorney filed suit against check 'n go alleging it jacked up interest rates from the state's legal limit of 36-percent to as high as 400-percent >> we found that a check and go was not adhering to the california interest rates limits. and stephen porter and with out of state banks to partner and get around those. we are going to work with people throughout the state to make sure that we get folks restitution that they deserve. >> reporter: the city has now reached a settlement with check n go. without admitting any wrongdoing check-n-go has agreed to refund up to 4.3 million dollars to californians who were overcharged when taking out online 4-month installment loans between november 2006 and june 2008. now grant here's the hitch. people only have 90 days to apply for this refund. and that 90 days begins tomorrow. >> grant: how much money can people expect to get back. >> depending on how much interest you were charged it could be anywhere from 20-dollars to 46-hundred dollars. now to find out if you qualify you can go to the website caloanr
